Terms and Conditions

The rules and responsibilities that apply when accessing or using First Year Generation School services.

Important: These terms are a general platform framework and are not a substitute for advice from qualified legal counsel. Enrollment, payment, safeguarding, refund, and governing-law terms should be customized before launch.

1. Acceptance of the terms

These Terms and Conditions govern access to and use of the First Year Generation School website, mobile application, learning platform, programs, content, and related services. By accessing or using the services, the user, or the parent or guardian acting for a minor user, agrees to these terms.

2. Eligibility and parent or guardian authority

Users must be legally able to enter into these terms. A minor may use the services only with the authorization and supervision required by applicable law and our enrollment process. A parent or guardian who creates or approves an account represents that they have authority to do so.

3. Accounts

Users must provide accurate information, keep login details confidential, and notify us of suspected unauthorized access. Users are responsible for activity occurring through their accounts unless caused by our failure to use reasonable safeguards.

4. Educational services

We may provide lessons, activities, projects, progress tools, mentoring, awards, certificates, parent insights, and other educational features. Program descriptions, schedules, instructors, features, and availability may change as the services develop.

5. Acceptable use

Users must not:

  • Use the services unlawfully, deceptively, or in a way that harms another person.
  • Harass, threaten, exploit, or impersonate students, families, staff, mentors, or other users.
  • Upload harmful code, attempt unauthorized access, bypass security, scrape content, or disrupt platform operation.
  • Post content that infringes intellectual property, privacy, confidentiality, or other rights.
  • Use the services to create or distribute unsafe, abusive, discriminatory, or inappropriate material.

6. Student submissions and portfolios

Users retain ownership of original work they submit. They grant us a limited license to host, process, display, and use that work as necessary to provide learning, feedback, assessment, portfolio, and recordkeeping functions. Public display or promotional use should occur only with appropriate permission.

7. Intellectual property

The platform, design, branding, curriculum, software, graphics, videos, and other materials provided by us or our licensors are protected by intellectual property laws. Users receive a limited, personal, non-exclusive, non-transferable right to use them for authorized educational purposes.

8. Payments, renewals, and refunds

If paid programs are offered, pricing, billing frequency, renewal terms, cancellation rules, and refund eligibility will be presented during enrollment or in a separate enrollment agreement. Users are responsible for authorized charges and applicable taxes.

9. Communications

Users may receive service, enrollment, safety, support, progress, and account communications. Marketing communications should be optional where required by law and may be unsubscribed from using the provided method.

10. Suspension and termination

We may restrict or terminate access when reasonably necessary to protect users, enforce these terms, address non-payment, investigate misuse, or comply with law. Where appropriate, we may provide notice and an opportunity to correct the issue.

11. Third-party services

The services may depend on or link to third-party services. Those services are governed by their own terms and policies, and we are not responsible for their independent acts or omissions.

12. Service availability

We aim to provide reliable access but do not guarantee uninterrupted or error-free operation. Maintenance, security incidents, internet conditions, vendor outages, or other events may affect availability.

13. Disclaimers

The services are provided on an “as available” basis to the extent permitted by law. Educational outcomes depend on many factors, including participation, prior knowledge, support, and circumstances. We do not guarantee specific grades, admissions outcomes, employment, certifications, or other results.

14. Limitation of liability

To the maximum extent permitted by law, First Year Generation School and its personnel will not be liable for indirect, incidental, special, consequential, or punitive loss arising from use of the services. Any liability that cannot legally be excluded will be limited as permitted by applicable law and any controlling enrollment agreement.

15. Indemnity

To the extent permitted by law, users agree to be responsible for losses or claims arising from their unlawful misuse of the services, infringement of another person’s rights, or material breach of these terms.

16. Governing law and disputes

The governing law, venue, dispute process, and any required consumer notices must be completed based on the organization’s legal entity and operating location before these terms are published.

17. Changes to the terms

We may update these terms when services, laws, or operational practices change. Continued use after an effective update may constitute acceptance where permitted by law.
